Where would "loser pays" begin? Would it have to be legislated in the states first?

Loser pays all does nothing to stop nuisance suits from being settled out of convenience. Typically they never go to court it's just a simple arrangement between lawyers to keep it out of court. It's also un enforcable unless you have some set fee in place to determine the losers cost's. Without that legitimate cases might never be brought.
