They re catching a few illegal charters every week. Part of the problem is that the fines that are listed are maximum fines and almost never actually levied. Now since this guy already as a Captain of the Port order, he s not going to get off lightly.

How about closing the barefoot charter loophole and let these owners actually do it right or don't do it. It's a way around inspections and safety requirements and only helps the owners of the boats who dont want to invest in preparing their vessels for inspection

This is why I quit chartering I couldn’t find a mate that could pass a drug test. It is a real PITA for fishing charters. Many times these mates float from boat to boat. I probably had 6 different guys I’d use. Having them all on the drug testing program got complicated and expensive.
 
While I was stationed at COTP Mobile AL, we were nailing illegal charters weekly. One recurring one was a guy in Gulf Shores that was determined to operate a 21' center console pulling 2 banana floats with up to 8 people on each. He said he didn't have to comply with USCG safety regulations, since the passengers were boarding and leaving directly from the water. He said it was the passenger's responsibility to provide their own PFD's. And the third time the Alabama State Police arrested him in compliance with a state-issued order to cease operation until meeting USCG regulations, he pulled the plug and sank his boat at the dock. I am a big fan of less governmental regulation, but he was way over the line. Oh and the 2 floats? He was daisy-chaining them behind the boat, no drug test program, no safety observer, just "a guy trying to make a living off idiot tourists that want a thrill". There were other illegal charter operations we shut down but that one from the early '90s will NEVER stop being a "this ain't no s**t" story when old Coasties gather.
