Absolutely amazing... I'm no fan of the Dolan family, but suing them for sponsoring the fireworks show??? Really?
 
How about suing them and having 27 people on a 34 foot boat?????Really?:confused:

Looking for the deepest pockets. This was a terrible accident. Unfortunately it seems like its the norm to look for others to blame. Maybe they should sue the US government for making July 4th a holiday.
 
I'm never going to ALLOW 27 People on my 43' hatt. That is operator error from the start. Ron White says it best , " you can't fix stupid " I'm with jack , sue the gov. it's their fault .
& when they win , I have some bridges I'd like to sell them. One is out in Beautiful California , The other is in New York. If you know of anyone interested ? Please send them my way. I may have a canyon available also..... Very nice stuff............
 
Maybe he should sue his own damn self for allowing his child on an overloaded boat.

What a crock. And suing the people who sponsored the fireworks? What a jackass.
 
The only parties at fault here are the vessel owners, operators and parents of the children on board. 27 people on a 34ft boat is poor judgement regardless of your boating experience. I wouldn't want 27 people on my 65ft boat. How can a captain keep track of everyone to ensure their safety? At some point common sense should have kicked in.
 
I wasn't going to get any deeper into it, but I have to agree, every adult on that boat has some culpability. I find it impossible to believe that every single one of them was so numb that nobody could see a problem with that before it left the dock.
 
Oh, Derek.... you may not have attended a fireworks display in a harbor in the past. I used to do this- including Baltimore Harbor (which has great fireworks, Fort McHenry and all that) No more. The whole thing is ridiculous: motoring in and trying to anchor, then watching the area fill up with more and more boaters who proceed to anchor over each others anchor rodes whilst getting totally obliterated drunk, then only twenty to thirty minutes of fireworks, accompanied by deafening hornblowing, and then the finale: hundreds of drunken boaters trying to fire up their boats, weigh anchor and all leave at once- in the dark. Usually without benefit of a full moon. It's amazing MORE people don't get killed.

I have had (I would not do this now!) eight people on my 36 Egg Harbor, years ago, for the Baltimore fireworks display. I am grateful nothing happened to any of them. I'll never do anything like that again.

I completely agree that the folks on the boat bear the sole responsibility for the disaster on the Kandi Won. I suppose, though, that faced with the choice of having to admit that you participated in the circumstances where your child died, on the one hand, and finding someone else to blame on the other, many of us would opt for the latter. And I agree that there is no way that a small boat like that ought to be carrying any number of passengers like it was that night.
 
The captain is always responsible for everyone aboard. End of story. If you are the captain, you make the calls. You abstain from drinking. You monitor everyone else. With 27 people, you are already in way over your head no matter what size recreational boat you have. This was a problem before they ever left the dock.
 
Where do you put 27 people and 27 pfds all the other safety gear on a small boat? How do you control the crowd from all going to one side? Where do you put all the beer? Is the weather going to hold out? Will some drunk ram me and kill 25 people? Where do the 27 people go potty?

I had 8 people on board our 53 once and that was too many for me! Can't imagine having 27 people on my boat unless I was helping in the evacuation at Dunkirk...
 
8 too many on a 53? My family is bigger than that.
 
I had 3 young boy's visiting us that drove me nutts. They were jumping around, running fore and aft. Dang, good thing we were at the dock or someone would have drown. Things happen very fast on the water. It's no place for people who dont respect the outdoors. So many people get hurt by purchasing a jet ski and taking off for the first ride. They dont respect it and pay the price. I once didnt let my 13 yr old daughter go snorkeling with a school group way down in the keys. Heck, I dont know who these people are and who the captain is or if he is safe. I caught some heat for that decision but I wasnt going to take that chance. I grew up on the water and know first hand what can happen, even on a good day things turn bad fast. 27 people on that boat is insane.
 
You could not safely have twenty-seven professional sailors on a boat that size, twenty-seven marines, twenty-seven of anyone. (although your chances of avoiding a disaster would be better with twenty-seven maritime professionals on board as opposed to twenty-seven amateurs) Overloaded boats capsize and dump their passengers into the water or trap them below decks when horizontal becomes vertical. The boat was insanely overloaded and I suspect any objective enquiry is going to state exactly that. And the captain IS responsible, as said above.

As to suing the people who put on the fireworks display, I am still brimming with disgust on that one. Are they going to try to convince a jury that it was an attractive nuisance, like a swimming pool that someone didn't put a fence around?
