As I recall the rules states max 6 passengers on an non inspected vessel, I don't know about the 100 ton thing. While this is true I'd think a responsible captain would know the rule, and follow it. Here again is an example that some people should not have the license. It might be common practice for some, that doesn't make it right. a captain operating under such situations would be labeled a PINO.

obviously you know better than the professionals involved in the chartering business including MARITIME ATTORNEYS who write and review these contracts...

dont' take it personally but i'll take the advice of a maritime attorney over what some guy has to say on a web forum...

Pascal is right,,same mis information is rampart in Canada....you have to be in the busines professionally to understand the rules...I see no conflicts here with Pascal or Ang..accepting queries..they did not go out ask for the inquiry..my 2c

All kidding and snipping aside. What one can do is one thing if nothing goes wrong. God forbid, what happens if the captain goes aground, someone get hurt. Who is responsible? The customer chartered the vessel, hired a captain, and off he goes on a cruise. True, the attorney will write the contract, what is in the contract assigning responsibility in the event of an accident. No I am not an attorney but a good friend of mine is a maritime attorney, we have discussed this issue in the past. His comment bascially, if it goes to court, given the way maritime law works it could get quite messy.

Everyone wants to make a living, I have no objection to what people do given it's legal. pascal quoting a price in a forum, that was not the information the OP was looking for. Perhaps taking it up in a PM would have been more prudent. Talking price when referring to quotes from other sources is not the same as quoting your price. Moderators have admonished people in the past for the exact same thing, this is what rubs some people the wrong way. Rules are rules, often times people play the rules for their own advantage, this can be as agrevating as people who just blatently break the rules.

Recently there has been talk of tightening up the responsibility of the license holder, possibly this is one of the areas they want to tighten up on.

regardless of the type of contract (crewed charter or bareboat) the captain is always responsible if something happens and it always be messy once lawyers get involved. Doens't matter if there are 2 people on the boat or 12 as long as boat is operated within the rules and regulations.

In this business, if you're involved in an accident you could have avoided you're basically done and need to look for another line of work. captains dont' have the ability that yard operators and mechanics have and be able to close shop and reopen under another name.

Most yards don't even have to close shop. Many who do shoddy work and cheat their customers somehow seem to remain in business. 1I feel for all the true professionals in yacht related businesses. The bums make it tough for the good guys. Sorry for the rant but I just had another deal go south due to a less than ethical broker.
 
Hey Jack, sorry I didn't reply sooner but we were down in Daytona on the boat. Took her out 3 times and she runs great. Yes i'll be bringing her home myself. Waiting until probably mid to late March when it starts to warm up here in N.C. Keep her in New Bern until late June then probably down to Beaufort with access to Cape Lookout which is what we bought her for. Only a 40 minute trip so the diesel prices won't be as much of an issue, I hope. Still trying to covince my wife to let me retire and have her continue to work, she can do it remotely, all she needs is access to an airport. Don't know why she doesn't like that idea!

Sounds like a good plan to me. That way you'll have the time to keep the ready for when she's not working. If that works let me know, I'll try it on my wife!
