Responses to the last two posts;
in regard to the USCG Info the Abstact of Title shows the seller as Mr. Turner and shows the new owner of the vessel, along with the new name of the vessel.. No lien indicated, sale date 12/30/08 and sale price $1.00. I am in the process of acquiring more specific info on the "sale". We'll see if its the real deal.

In response to Brian's questions, without giving my opponents, who frequent the site too much info, I was the high bidder on the boat from start to finish of the last auction. The "seller" was the broker. The contact was the broker, the one responding to questions during the course of the auction was the broker. Te auction began on 11/27, which was Thanksgiving day,my bid was entered the 28th of November. I exchanged emails with the broker about a survey and a commission being shared with my broker around the 1st or 2nd of December, got rather rude responses to my questions basically informing me that the sale would be final at the end of the auction, no contingent survey and no sharing of any commission with my broker. Apparently on December 01, and 02 the broker but a sentence in the description of the auction that stated generally the boat will be sold to any bidder over $195,000.00 however the auction was never changed to a "reserve" auction and there was no communication to any of the four bidders that I am aware of, certainly not to me that the terms of the auction changed or that the auction was changed to a "reserve" auction. The auction ran its course and I was declared the winner by ebay.

Could I have moved the Court for a Preliminary Injunction, yes and I had one drafted, but i changed my mind, for reasons that I will keep to myself at this point but reasons I felt were in my best interest. We will see how that plays out.
 
Again good luck I think the fact a broker was involved should help you. A professional knows better than to agree to the auction process and then try to manipulate it half way thru.
