  1. OWNER - I own a Hatteras Yacht
Hatteras Model
40' DOUBLE CABIN-Series I (1986 - 1989)
Getting ready to put a bid in on a 53ed here in New Bern, n.c. Broker started engines on a cold start last night. Stb took about 3-4 seconds to fire, very little white smoke for about 10 seconds then not much at all, was getting dark at that time. Port fired right away, had lots of white smoke for about 10 seconds then settled down to minimal, again almost dark. No hunting, settled down into nice smooth idle. any comments?

Skip,
I don't have any specific info on that boat but I would be careful what you post until you have a signed, accepted offer. I lost the last 2 boats I was looking at by an offer coming in out of nowhere right when we submitted our offer. It has also happened to me with realestate so I suspect that things haven't been on the up and up. You never know who is lurking here and how they may use info you post.
Good luck with the purchase. Hope you have better luck than I'm having.

Jack, you're referring to the 125 offer on Hearts Desire i assume. Not the boat I'm bidding on now as that was refused. Different boat, different condition different $s.

Lab,
Since you made a bid on Hearts Desire, can you share your opinion of condition. Is it a good value at 130-150K, realizing that you thought it a good buy at your bid? Anything in particular jump out at ya when you saw it? Your thoughts if you don't mind.

Skip, is this Buddy's boat?

No I'm speaking in general. Be careful about sharing info on a boat you don't have locked up. Amazing how everyone keeps saying how bad boat sales are but I can't seem to get one under contract. Every time I submit an offer, someone gets in a few hours or a day ahead of me and for close to the same money.

Just this week I lost a deal on a boat I put an offer in the end of August. The deal was rejected and then they came back asking if I would resubmit my offer. I was told there were no other offers and no one else has looked at the boat. Miraculously they got an offer in, approved and financing set up all between Friday at 5pm and Monday AM. Interesting how that offer came in just slightly above mine. Strange thing is their offer has a finance and survey contingency and the buyer hasn't even seen the boat yet! My offer was cash, no survey and the offer was based on an extremely thorough inspection equivalent to a survey. Sorry to rant, but needless to say I'm a bit pissed off at the seller's agents.

Oh I see it is not Buddy's. Looks nice in pix!

Jack,

You are absolutely right. It's called collusion usually between the sellers broker/agent and a friend. It has happened to me several times on real estate deals and if I could prove it, I'd look to have the guilty parties punished such as a RE broker losing his RE license. Of course a good way to hopefully prevent this kind of activity, deal exclusively with a highly reputable agent.

Peterson has a good reputation. He sells a lot of boats in the area.

I'll comment: What the heck is that steering wheel at the lower helm?!!!

Yeah, that's a total deal breaker for me. looks like it was stolen from one of those Carver/Trojan 44' Euro style express cruisers

I've submitted offers and was informed they were rejected only to learn the broker never submitted them to the owner. This is why I don't even look at boats through a dealer. They only care about their commission not the seller who they represent nor the buyer who they want to rip off. Sorry but my opinion of brokers based on past experiences.

I've had it happen to me on real estate deals also. Problem here is I am working with someone I have the utmost respect for and he has concerns that we've been played. We have no control of how the sellers agents behave. I can't be sure my offer was ever presented to the seller. From now on all offers i submit will be presented in the AM and will expire by end of business. I also will require a signed rejection of the offer from the seller, not the listing broker.

This is my concern also. There are a few players involved in my current deal. I am 1000% confident in my broker and his integrity. I'm not sure about the listing broker but believe he is OK. There is another agent involved and that seems to be the wild card. That is who was supposed to present my offers to the seller. I don't want to get into the details of what happened but I find it hard to believe I wasn't played. Not sure how to better protect myself and understand why brokers get a bad rap. I feel for those who are upstanding and have to deal with the cheats that give the industry a bad reputation.

As a broker ( former real estate and current yacht) I present every offer to my seller as I feel it is my fiduciary responsibility. In this state the licensing may be different than in others and some do not require on at all but I set a standard of what I would feel comfortable with if I were in the sellers shoes. The others i work with also feel that way and work very hard for their customers. Are all the local brokers like this? Not just no but HELL NO. we have some that collect listings. Some with funky contracts that if you re list with anothr broker they still get paid if the boat is sold within 60-90 days even if they had nothing to do with it.

A friend has a boat listed ( from before I met him) with one of these and they do nothing. He asked them to cancel it and they would not without causing him some problems. He raised the price from $80 K to $250 and will demand they advertise it and do as originally promised or he will take the broker to court. Sometimes the table can be turned.

How does that protect you??...would your recent experience have been any different???

Sounds more like the seller might have been screwed. Also sounds like a seller and a friend could get together to test a broker with the friend making an "offer" and the seller monitoring to see if he/she ever gets the offer.

Regarding the engine start up: sounds normal...but the engines might have been already warm.....via block heaters or a recent start up....always a good idea to check engines with an infrared thermometer before start up when "tesing"....
nothing like going for a ride under load when the engines are run hard for 20 or 30 minutes....that and maintenance records will tell a story...

Yes it would insure that the seller saw my offer. I have no problem if we can't get together on price and terms.

Good advice Jack. I had a real estate broker Took my offer to another bidder on a property to rachet up the price. I ran into the guy that owned the RE and found out he never saw my offer. I did every thing I could to get the brokers lic pulled but he's still selling RE. Ya gota be carefull.
Its like a lot of these Ebay auctions they have shill bidders in there to get the price up.I don't know how many things that I've seen sold only to be relisted again over and over.

Last thing I would worry about is the wheel in the pilothouse. Peterson sold my previous hat and I have come to know him as a straight shooter. George, boat is at the Hilton. Teak and holly is the best I have ever seen. Some condition questions will have to be answered and the paint on the hull is not in great shape. Overall interior really suits my wife however as we all know lipstick can be put on a pig. Big ticket items ain't in the solon or saloon as some would say. Got to think hard about this and maybe just wait a few more months to see if the economy picks up any after the elections.
