Sheriff's Auction

is scheduled to be auctioned by the Jackson County Sheriff on September 24, 2012.

It was seized to enforce a civil judgment unrelated to the boat. To my understanding the boat is in fine shape. My firm represents the holder of the judgment. It would be in the best interest of all concerned for the auction to bring a fair, at least by auction standards, price. Therefore, my post.

On Saturday and Sunday, Sept 22-23, The boat is to be docked at the Pascagoula public docks, on South Pascagoula street for inspection. Until then, it is at the sheriff's dock and not currently available for viewing.

We do not control the boat or the sale, the sheriff does, but if you have any questions send me a pm.

I trust this post does not violate the rules, if anyone thinks otherwise let me know and I will be happy to remove it.

I may need to clarify that the actual auction will take place at the Jackson County Courthouse front steps. The sheriff has published notice which contains the details of the sale. I will be happy to email a copy of the notice to anyone who requests it.

The Court postponed the scheduled September 24 auction and the sheriff will have to re-publish notice of the sale. I do not think there will be any further delays.

Since notice must be published for 3 consecutive weeks, I estimate, but do not yet know, that the new sale date will be Monday October 15. The location of the auction will still be on the courthouse steps.

I believe that the boat will still be available for viewing at the Inner Harbor in Pascagoula this weekend. I am in the process of getting this confirmed and will advise once it is determined.

I have spoke with the deputy sheriff in charge of the sale and he expects that he will be able to publish notice in time for an October 15 sale date. The location of the auction will still be on the courthouse steps.

The deputy also advised that the boat will remain at the Coast Guard station until the weekend before the sale. The boat will be available for viewing Saturday and Sunday October 13 and 14 at the Pascagoula Inner Harbor, and not this coming weekend.

The auction was held yesterday morning; however, the sale was complicated by a stay issued by the Court and then lifted. This complicated the opportunity for prospective bidders to inspect the boat prior to the auction. On the morning of the sale the sheriff set a reserve of $65,000 and there were no bids. The sale has been rescheduled, I believe, for 12/3.

The judgment debtor is indicating now that he intends to post a bond to stay further enforcement of the judgment which would stop the auction and return the boat to the owner. Once I hear something definitive I will post that.
