This is a video of girls on a boat and all you have to say is that I'm doing illegal charters. It's sad. Really sad.
NONE of you know what I do or don't do. It's a video of girls on a boat. We LOVE the haters though, because it means we're doing well. Maybe this just isn't the website for people that are REALLY enjoying their Hatteras. Maybe you should get YOUR facts straight before you start talking shit. Anyway, I post for these videos for your enjoyment. It takes hours of our time to put these videos together. We don't make any money doing this, and I'm getting this crap from the crowd? I don't mind. You obviously keep watching so I'll keep posting. Lol

This has nothing to do with your video and everything to do with your comment. Enlighten us as to how you have no legal ownership of this boat. If you’ve found a loophole in the regs, share it with those of us who aren’t as smart as you are. That’s what this site is all about... Hatteras owners helping other Hatteras owners along with the odd Viking or whatever else owner.

Sure. Not that it's anyone's business what I own or don't own, nor am I claiming to be smarter than anyone but if you don't know what youre talking about or if all you have is negative remarks, sometimes it's best to keep it to yourself. Actually, it's always best to keep it to yourself.
But, if you say, "Hey, can you tell us how you do it?" that may result in something positive.
In the spirit of being helpful and as an expert on the subject. Our company, Miami Cruise Yacht Charters, is a managing company for boat owners that want to get their boat rented out legally. We charge between $1000 and $2000 to help a boat owner get their boat ready for Coast Guard inspections. Then we manage the charter of their boat. We hire the Captains and we manage the bookings.
Here's what you need to know as per the remarks on the thread:
1. If you don't own a boat and you don't have ownership in a corporation that owns a boat, if one does, then you can Captain the boat as a bareboat as long as the charter has SELECTED you before making any contract or you getting paid. (That's the simple version)
There's no loophole. It's simple.
1. Don't have any ownership in the boat.
2. Allow the charterer to SELECT their own Captain. (owner can recommend, but not require)(since tourists don't live here and usually don't happen to know a Captain in the area, they will usually go with the one the owner recommends)(offer the charter options of different vetted Captains and get it in writing that they selected you)(Of course they can hire whoever they want as long as the Captain can provide credentials as per owner's requirements)(Owner may have requirements)
3. Owner cannot be on board.
4. Charterer will sign a lease to possess the boat and must have full possession of the vessel.
5. Charterer will sign a contract with the Captain they hire and the Charterer must pay Captain separately.
6. Captain must be on a random drug testing program.
7. Captain must have all required credentials.
8. Owner may not be on board during the charter. (owner must relinquish themselves from the equation)
9. Owner may not have control of the boat while it is being rented.
10. Boat must have all CG required safety equipment.
11. Boat must be properly registered. Cannot be documented as "Pleasure" must be "Coast Wise"
12. Boat should have proper insurance provided by the charterer. (not mandatory)
13. Barboat means BARE. Nothing may be provided by the owner. No food, No drinks (If you provide food or drink for the charter, it must be itemized in your bareboat charter agreement as a separate payment)
14. Fuel must be paid by Charterer. (It may be projected in the Bareboat charter agreement and charged separately)
FYI:
-Carrying up to 6 passengers is a charter and must follow certain guidelines.
-A bareboat may carry 1 "charterer" plus up to 12 passengers. (13)
-A 6 pack charter vessel may be, but is not required to be inspected. (does not require COI)
-A Bareboat is not a charter, it's a recreational voyage AND does not require a Captain unless the owner requires one. It's a rented boat and does not need to follow the same rules as long as it's not acting as an inspected vessel. If it's a bareboat acting as an inspected vessel, they can be sited as if it were an inspected vessel in which case there may be MANY violations. Too many people think they are exempt from a bunch of rules because they THINK they are a bareboat but are actually ACTING AS AN INSPECTED VESSEL and they don't even know it. This is why so many people get in so much trouble. One small violation turns into 4 huge ones.
Now I'll address all the comments about me being illegal. I'm not. I actually work with the Coast Guard in getting our vessels inspected and legal. None of the boats that we manage operate without being inspected by the Coast Guard first.

I for one enjoy your videos. I also appreciate the above information. I am curious how you are able live aboard the Masterplan if you don’t own it? I’m not busting balls but looking for information. We close today on a new to us Hatt and would like to learn some ins and outs of creative ownership. Oh and what was the source of your water leak? You never mentioned it.

Hi Sadey, Thanks for your support. There'es no loophole and anything illegal about this but feel free to send me a private message and I'll explain. My debate is over. lol
As far as the water leak. The only place I know of and was able to source is the drive shaft packing glands. If your bilge pumps stop working, the engine bilge fills surprisingly fast. When we first bought the boat, I was going to Captain School in Ft Lauderdale and planned to stay up there for the duration of the schooling. But when we got the boat home for the first time, I noticed one engine room filling with water and I had No experience with this or any other boat. So When i went to bed, I MANUALLY drained the engine room, when I got up in the morning I drained the engine room, when I got home from school, I drained the engine room and the process started over each day until I could figure out the problem, (Which ended up being a dead battery charger on the 12 V side). This went on for days but each time I drained the engine room, It was already overflowing into the Generator room which had a backup bilge on a different battery system. So, I think the water coming in is from the packing glands. (That was the starbord side) (Now the port side was dead and the reason it was a big deal is because even though NOW I had experience, I still could not diagnose the reason the pump wasn't working. And the reason I couldn't figure it out is because I was testing for 12 V when it was on a different battery system (32V) Now that I figured out why the bilge wasn't working, (because it was dead) I replaced it and it's working fine. The point of the video was to show that with these old boats, never assume that things are what they are supposed to be. Anything is possible so when diagnosing, you have to think outside the box.

You might do well to take your advice from more experienced owners, operators and/or captains. There are a great many of them on this forum that can explain proper fixes as opposed to experimentation. I don't think that's a slam on anyone. Anyone old enough to appreciate a classic Hatteras is old enough to know there are no shortcuts or loopholes.
